I (the person signing below) agree as follows:

1. Loaned Equipment. StreetCode is temporarily loaning to me a new or used computer, and if also loaned to me, accompanying charger power adapter, mouse, monitor, keyboard, extension cord or headphones (“Loaned Equipment”).

2. Loaned Equipment Period. The Loaned Equipment will be for the period of the day you receive the computer until 1 year from your pick up date. StreetCode staff will be reaching out at the end of the Loaned Equipment Period about the process of return/renewal.

3. Possession of Loaned Equipment. The Loaned Equipment will remain in my possession or under my control at all times.

4. Loaned Equipment is for Personal Use and Not For-Resale. The Loaned Equipment is solely for my personal use and is not to be re-lent, resold or otherwise disposed of. Title to the Loaned Equipment remains with StreetCode at all times.

5. Care and Maintenance of Loaned Equipment. I take sole responsibility for the well-being, care and maintenance of the Loaned Equipment; such as, I will not consume food/drinks in close proximity of the Loaned Equipment.

6. Use of Loaned Equipment for Legal Purposes. I will use the Loaned Equipment only for the legitimate purposes for which the Loaned Equipment is provided and not for any illegal purposes.

7. Surveys. I will fill out occasional surveys from StreetCode regarding use of the Loaned Equipment.

8. Condition “As Is”. StreetCode is not making any representations, warranties, or guarantees about the Loaned Equipment, including any implied warranties of merchantability and/or fitness for any purpose. I accept the Loaned Equipment “as is,” including any existing faults and software or hardware limitations. I understand that StreetCode will not provide anything other than the Loaned Equipment, such as any instructions or follow-up services, replacement parts or repairs.

9. Assumption of Risk. I understand that there are risks related to the possession, use, or misuse of the Loaned Equipment. I assume full responsibility for all risks arising directly or indirectly from my possession, use, or misuse of the Loaned Equipment, both known and unknown, regardless of the cause.

10. Waiver and Release. I waive and release any and all claims against StreetCode, its officers, agents, directors, and employees (collectively, “StreetCode Parties”) with respect to any and all injury, disability, death, loss, or damage to property resulting from possession, use, or misuse of the Loaned Equipment, regardless of the cause and even if caused by negligence, whether passive or active. I agree not to sue any of the StreetCode Parties on the basis of these waived and released claims. I waive the protections of Section 1542 of the California Civil Code, which provides that a general release does not extend to certain claims not known to me at the time I signed this document.

I am an adult age 18 or older. I have read, understand and freely agree to the terms of this contract. I understand that this contract covers each and every item of Loaned Equipment I receive. I understand that failure to follow any of these terms may result in me being unable to receive other Loaned Equipment in the future.
